I HAVE READ AND UNDERSTAND THE BELOW GENERAL RELEASE AGREEMENT AND THE COVID-19 LODGE USE RELEASE AND INDEMNIFICATION , AND I AM KNOWINGLY AND VOLUNTARILY COMPLETING THE ABOVE INFORMATION  AND GRANTING THIS GENERAL RELEASE TO THE CLUB AND CLUB PERSONS.   *

General Release Agreemnt 

  1. I understand that the Central Jersey Ski Club, (hereafter the "Club") is a year-round skiing, sports and social Club, which sponsors a variety of activities, including skiing, snowboarding, kayaking, biking, hiking, golf, and other sports and social events (collectively, the "Club Activities").
  2. I am aware that many of the Club Activities organized and/or sponsored by the Club, including those enumerated in paragraph 1 above, are inherently dangerous activities which may involve the risk of serious injury or even death.
  3. I understand that the Club is a New Jersey not-for-profit corporation, and that its officers, directors, committee chairpersons, committee members, and members (collectively, "Club Persons") serve only in the capacity of volunteers. I agree that by participating in any Club-related activity, including Club Activities, I am responsible for my own safety and agree that I knowingly and voluntarily assume the risks involved in any such activity. 
  4. To the fullest extent allowed by law, I hereby waive my right to, and I agree that I will not, institute any lawsuit or other legal action against (a) the Club, or (b) any Club Persons, as a result of my participation in or injury from any Club-related, Club organized, Club-advertised, Club-sponsored or Club-subsidized activity, including Club Activities.
  5. I understand and acknowledge that the Club is acting in reliance upon the agreements made by me in this Release in order to extend to me the opportunity to participate in Club-related, Club-organized, Club-advertised, Club-sponsored or Club-subsidized activities, including Club Activities, would not be extended to me were I not willing to abide by the terms of this document.
  6. I understand and acknowledge that Club Persons are acting in reliance upon the agreements made by me in this Release in volunteering their services and, in some instances, their homes and vehicles and that, were I not willing to abide by the terms of this document, their services, homes and vehicles would not be made available to me.
  7. I hereby agree to release and discharge the Club, all Club Persons, and their successors and assigns, from any and all actions, causes of action, suits, charges, obligations, claims and demands of any kind whatsoever, in law or equity, that I or my heirs, executors, administrators, successors and assigns ever had, now have or hereafter can, shall or may have, upon or by reason of any matter, cause or thing whatsoever from the beginning of time to the date of this Release, and for so long as I participate in any Club-related, Club organized, Club-advertised, Club-sponsored or Club-subsidized activity, including Club Activities.
  8. By signing this Agreement, I also hereby agree to abide by the Constitution and By-Laws of the Club, which are available for review on the Club's web site. I also agree to abide by all posted rules, regulations and instructions in the Club's lodge in Rochester, Vermont.
  9. I give the Club permission to record my image and grant the Club all rights to use these photographs in any medium for promotional, advertising, or other purposes that support the mission of the Club.
  10. This Release shall bind me, my heirs, executors, administrators, representatives, successors and assigns.
  11. I expressly agree that the foregoing General Release is intended to be as broad and inclusive as is permitted by law of the State of New Jersey and that if any portion hereof is held invalid, it is agreed that the balance shall continue in full legal force and effect.

Covid-19 - Lodge Use Release and Indemnification

  1. In particular, I represent that I have not tested positive for COVID-19 within the last 10 days, and I have not been in direct personal contact with someone who has tested positive for COVID-19 within the last 10 days either. If I do test positive for COVID-19 or come into contact with someone who has, or if my temperature exceeds 100 degrees Fahrenheit, and/or if I experience other COVID-19 related symptoms, I agree that I will not seek to enter the CJSC Lodge until I am no longer symptomatic for three straight days.
     
  2. I agree to observe the safety requirements within the CJCS Lodge spaces—including when/if specified; wearing a personal mask when required, and observing required routes of circulation, occupancy limitations, social distancing and sanitization requirements.
     
  3. By accepting this reservation to use the CJSC Lodge, I hereby waive, release, and discharge and covenant not to sue the Central Jersey Ski Club for any or all claims of liability for personal injury, accidents, property damage, and any other claim arising out of or in connection with my use of the CJSC Lodge. Further, I agree to defend, indemnify and hold harmless the Central Jersey Ski Club from all losses, claims, expenses and demands, including attorneys’ fees, that Central Jersey Ski Club may incur arising out of or in connection with my use of the CJSC Lodge. I further agree to be responsible and liable for the actions and safety of every person in my group.
     
  4. If I become ill within 10 days of departing the lodge, I will advise Reservations. Without identifying me, Reservations will inform members who were at the lodge during the same time period. Contact tracing slows the spread of COVID-19 by: 1. Letting people know they may have been exposed to COVID-19 and should monitor their health for signs and symptoms of COVID-19. 2. Helping people who may have been exposed to COVID-19 get tested; and 3. Asking people to self-isolate if they have COVID-19 or self-quarantine if they are a close contact.
     
  5. I acknowledge that inherent risks of exposure to COVID-19 exist in any public place. COVID-19 is an extremely contagious disease that can lead to severe illness and death, especially for senior citizens and individuals with underlying medical conditions.
     
  6. By visiting the CJSC Lodge, I voluntarily and completely assume all risk related to exposure to COVID-19.
